Trying to buy a Top Hat & what an interesting ride its been so far
I pity the poor people trying to sell through a "Broker"
I have found some horrible truths about some brokers`
Firstly not wanting to show potential buyers the boats.
I have had excuses such as too hot, too windy, too wet, not too cold yet as I guess will be used in winter time. Not bothering to return calls about trying to make an appointment to view. Gone sailing Fridays gone sailing Saturdays gone sailing Sundays I guess on other peoples boats ?
One Top Hat I have been trying to view in Lake Macquarie through a major mariner at Marmong Point for nearly 3 months, yacht has been on the market for over 6months Was told it was sold but still advertised & finally contacted the owner direct through yachtie friends knowing the yacht Owner said still for sale & costing about $100 a week for their mooring +advertising.
A beauty at Pittwater from a broker(John Lam...) well known for compass careel's in earlier days
Now I have to take to Dept of Fair Trading as stole my deposit & refused to give a copy of the contract after signing it & found out it was a selling contract not a holding deposit contract. ( very silly on my behalf but a very crafty salesman) I had arranged a survey & test sail but was refused an independant surveyor so they got their own mate who said about $1500 in repairs but would not commit to the amount so finally got an independant to view & he quoted $5000 in repairs in writing. When speaking to John asking for refund minus their costs, replied bad luck "take me to Dept of Fair trading as been there twice & won both times" (pity poor other people). So spoke to a solicitor & found out he was ripped off by them aswell when trying to sell his Adams 31 & a friend trying to sell his H28 both lost a fair bit of $ as yachts did not sell as no one could view them yet both guys took to another broker & both sold within 1 month. Lucky ? or an honourable broker ?
Anyway thought I might just point out a few hiccups in trying to buy a yacht & maybe help a few trying to sell theirs.

On a good note the guys selling privatley have been willing to show their yachts, test sail & point out any known problems & more than happy for a survey from anyone

Adam,

Sounds like you have had a rough trip. I brought my Top Hat through JL and while I knew that some repairs had been done, caused I believe by JL & co, I never got a list of repairs done, dispite repeated requests. I only found out the cause of all the problems late last year but now have a beaut yacht!
